It’s that time of year again. Finals are over. Graduation has commenced. And those working in student housing have kicked it into high gear.

Willful Holdovers

A holdover resident is one who has given or received proper written notice to vacate the apartment but does not. The landlord’s remedy is to file an eviction action to get possession of the rental unit returned; this action would then entitle the landlord to rent owed plus court costs and attorney’s fees. In addition, the Arizona Residential Landlord and Tenant Act (ARLTA) provides a penalty that also may be awarded to the landlord.

A.R.S. § 33-1375(C) of the Arizona Residential Landlord and Tenant Act states in part:

Terminating Resident Utility Services

Questions often arise regarding a landlord’s right to terminate utility services to a renter-occupied dwelling. Understanding when and how to do this is essential to avoid liability.
To determine whether management has a right to discontinue utility services, one must first look to the terms of the rental agreement. Only two circumstances can exist. The first is where the landlord provides the utility, and the second is where the resident is responsible for the service.
